Definition of functions and responsibilities

Beyond the attributions that correspond to the people with specific preventive functions, the organization of the prevention is based on the definition of clear and unequivocal form of the functions and preventive responsibilities in the different hierarchic levels from a company. In order to define the same ones in this NTP one is going away to start off, as a example, of a company "type" of three hierarchic levels, with the following structure: Direction, intermediate People in charge of the different functional units, Controls, and Workers. The chosen preventive modality in the example is the one of designated Worker (also denominated in this Coordinating document of Prevention, with the purpose of not confusing the figure of designated worker when the chosen modality is the complete agreement of the preventive activity with an Other people's Service of Prevention). It has been considered that also exists Delegates of Prevention and Committee of Security and Health in the Work.

Next possible functions and competitions of each group of the organization of the company are for a reason or purpose merely of example. Evidently the greater emphasis in an u others will depend on the company policy.

Address

It is responsibility of the direction (industralist) guaranteeing the security and the health of the workers of his position. She is the one in charge to develop to the preventive organization of the company defining the functions and responsibilities corresponding to each hierarchic level. It is fundamental for the success of the preventive action that is implied actively, establishing to power to be in writing a series of commitments and objectives to fulfill. Some examples of possible performances to follow are:

To establish annual objectives of Prevention of Labor Risks in coherence with the existing preventive policy

bullet

To establish the necessary and obligatory organizational structure for the accomplishment of the preventive activities (*)

bullet

To designate to a person in the matter of Security and Health, that coordinates and controls the performances and maintains informed to the organization into most significant in this matter.

To establish the competitions and the interrelations of each department in the matter of prevention of labor risks.

bullet

To assign the resources necessary, as much human as material, to obtain to the objectives establecidos.(*)

bullet

To promote and to participate in periodic meetings to analyze and to discuss to subjects of security and health, and to try to also deal with these subjects in the normal meetings work.

bullet

To visit the work places periodically to be able to stimulate efficient behaviors, to detect deficiencies and to transfer interest by its solution.

bullet

Periodically to make internal audits and revisions of the policy, organization and activities of the company, reviewing the results of the same one.

bullet

To show interest by the labor accidents happened and the adopted measures to avoid its repetition.

bullet

To recognize the people its profits, according to the objectives and raised performances

bullet

To consult to the workers in the adoption of decisions that can affect the security, health and conditions of work (*)

bullet

To be interested and to participate, when therefore one settles down, in the procedimentadas preventive activities

bullet

Other actions that are considered opportune.

People in charge of the different functional units

The people in charge of the different departments or functional units from the company are the ones in charge to impel, to coordinate and to control that all the carried out performances in their respective areas follow the directives established by the direction on prevention of labor risks.

As specific performances of this hierarchic level could be enumerated the following ones:

To lend the aid and necessary means to the intermediate controls of its functional unit in order that these can accomplish their missions correctly. To such aim they will have to assure that such intermediate controls properly are formed.

To fulfill and to make fulfill preventive the objectives established, establishing of specific for its unit, on the basis of the received directives

bullet

To cooperate with the different functional units from the company in order to avoid duplicity or contrariedad of performances.

bullet

To integrate the aspects of Security and Labor Health, as well as of Quality and Medio.ambiente in the meetings of work with its collaborators and in the procedures of performance of the unit.

bullet

Periodically to review the conditions of work of its scope of performance, according to the established procedure.

bullet

To participate in the investigation of all the accidents with injury happened in its functional unit and to be interested in the adopted solutions to avoid its repetition.

bullet

To participate in the planned preventive activities, according to the established procedure

bullet

Occasionally to promote and to participate in the elaboration of procedures of work in those tasks critics that are made normal or in their functional unit.

bullet

To carry out a pursuit and combat operations control of improvement to make in its scope of performance, arisen from the different preventive performances

bullet

Other functions nondescribed that the direction establishes.

Intermediate controls

Between the intermediate command missions they could appear the following ones:

To elaborate and to transmit the referring procedures and instructions to the works that are made in their area of competition.

bullet

To guard by the fulfillment of the procedures and instructions of the workers to its position, making sure that security and health in the work are carried out in the due conditions of

To inform to the affected workers of the existing risks in the protection and work places and of the preventive measures to adopt.

bullet

To analyze the works that are carried out in their area detecting possible risks or deficiencies for their elimination or minimización

bullet

To plan and to organize the works of its scope of responsibility, considering the preventive aspects to consider

bullet

To watch with special attention those situations critics that can arise, either in the accomplishment of new tasks or or the existing ones, to adopt immediate cogoverning measures.

To investigate all the accidents and incidents happened in its area of work, according to the established procedure and to apply the preventive measures necessary to avoid its repetition

bullet

To form to the workers for the safe and correct accomplishment of the tasks that they have assigned and of detecting the deficiencies on the matter.

To apply in the measurement of its possibilities the preventive measures and suggestions of improvement that their workers propose.

bullet

To transmit to its collaborating interest by its conditions of work and for recognizing its performances and their profits

bullet

To apply in term the decided preventive measures in its scope of performance

Workers

Within the responsibilities of the workers the following ones could be included:

To guard, according to its possibilities and by means of the fulfillment of the prevention measures that in each case are adopted, by its own security and health in the work and by the one of those other people to which it can affect his professional activity, because of its acts and omissions in the work, in accordance with their formation and the instructions of the industralist. To use suitably, in agreement with its the foreseeable nature and risks, the machines, apparatuses, dangerous tools, substances, equipment of transport and, in general, any other means with which they develop its activity (*)

bullet

To correctly use means and facilitated protective equipment (*)

bullet

Not to put outside operation and to correctly use the existing safeties or that settles in means related to their activity or place of work in which this one takes place (*)

bullet

To inform immediately to its superior hierarchic direct one, and the designated workers to make activities of protection and prevention, in its case, to the service of prevention about any situation that considers can present/display a risk for the security and health. (*)

bullet

To contribute to the fulfillment of the obligations established by the competent authority with the purpose of protecting the security and health of the workers in the work (*)

bullet

To cooperate with its direct controls to be able to guarantee conditions of work that are safe and they do not involve risks for the security and the health of the workers in the work (*)

bullet

To maintain clean and ordered its surroundings of work, locating the equipment and materials in the assigned places.

bullet

To suggest the measures that consider opportune in their scope of work to improve the quality, the security and the effectiveness of the same one.

bullet

Other functions that the direction creates advisable and according to the preventive system approved and with the consultation the representatives of the workers.

Designated worker

The designated worker is the person named by the direction to collaborate actively in the development of the preventive plan, being able to make compatible his functions in this matter with others, based on his capacities and availability. He would have to have like mini formation to develop functions of basic level ( Art. 35 of the RSP ), although could be recommendable that according to the circumstances (so large of company, activity, risks, characteristics of the preventive plan, etc.) the designated worker was qualified to make functions of intermediate level and even superior ( Art. 36 and 37 of the RSP ) Within its functions in preventive matter they could appear the following ones:

To advise and to support the different established preventive activities

bullet

To promote the safe behaviors and the correct use of the protection and work parties, and to foment the interest and cooperation of the workers in the action preventiva.(*)

To promote, in individual, basic the preventive performances, such as the order, the cleaning, the signaling and the general maintenance, and to carry out its pursuit and control (*)

bullet

To collaborate in the evaluation and the control of the general and specific risks of the company, carrying out visits to the effect, attention to complaints and suggestions, registry of data, and whichever analogous functions are necessary (*)

bullet

To act in case of emergency and first aid managing the first interventions to the effect (*)

bullet

Of attending and of participating in the meetings of the Committee of Security and Health, when it exists, in quality of asesor.

bullet

Canalizar the information of interest in preventive matter towards the structure of the organization, as well as the results of the development of combat operations of preventiva.

bullet

To facilitate the coordination of the interdepartmental relations in order to facilitate the cooperation necessary and to avoid adverse defects and effects for the security and health in trabajo.

To review and to control the documentation referring to the Prevention of Labor Risks assuring his to disponibilidad.

Delegates of Prevención

The delegates of Prevention are the representatives of the workers with specific functions in the matter of prevention of risks in the work. They will be designated by and between the representatives of the personnel. Its election and the number comes determined by the Law 31/1995 or pacts and agreements between sectors. In some occasions their functions can to this end be carried out by other constituted organs. So and as it indicates the legislation are competitions and faculties of the Delegates of Prevention:

To collaborate with the direction of the company in the improvement of the action preventiva.(*)

To promote and to foment the cooperation of the workers in the execution of the norm on prevention of labor risks (*)

bullet

To be consulted by the industralist, with previous character to its execution, about any decision that could have substantial effect on the security and the health of the workers (*)

bullet

To exert a work of monitoring and control on the fulfillment of the norm of prevention of labor risks (*)

bullet

To assume the competitions of the Committee of Security and Health, if this one does not exist (*)

bullet

To accompany to the technicians in the evaluations of preventive character of the medio.ambiente of work (*)

bullet

To accompany to the Inspectors by Work and Social Security in the visits that make in the work centers (*)

bullet

To have access to the information and documentation relative to the conditions of work that are necessary for the exercise of their functions (*)

bullet

To be informed by the industralist on the damages produced in the health into the workers and on the activities into protection and prevention into the company (*)

bullet

To make visits to the work places to exert a work of monitoring and control of the state of the conditions of work (*)

bullet

To communicate during the day of work with the workers, without alters the normal development of the productive process (*)

To promote improvements in the levels of protection of the security and health of the workers (*)

To propose to the organ of representation of the workers the adoption in the agreement of paralyzation of the activities in which a serious and imminent risk exists (*)

To go to the Inspection of Work and Social Security if they consider that the adopted measures and the used means are not sufficient to guarantee the security and health in the work (*)
